English-language consolidated version incorporating the Activities, Channels, audiovisual archives, territorial rights, competition integrity, human-rights and animal-welfare rules, content restrictions, AI, payments, and the two-year archive revenue-sharing framework.
Important implementation note. Before publication, the operating entity's legal name, registered address, jurisdiction of incorporation, effective date, governing law, dispute-resolution provisions, and legally required consumer notices must be completed and reviewed by qualified counsel for the launch jurisdictions.
PREAMBLE
The ecosystem includes two fundamental components: (1) CULTSPORTS ACTIVITIES, covering sports and cultural activities, talents, challenges, competitions, performances, events, voting, evaluations and rankings; and (2) CULTSPORTS CHANNELS, covering CultSports Global's audiovisual services, including global, continental, regional, national and city channels, live broadcasts, rebroadcasts, programs, excerpts and archives.
These Terms of Use (the “Terms”) form the general contractual framework governing use of CultSports Global. Registration, access to, or use of the Platform constitutes acceptance of these Terms in accordance with applicable law.
TITLE I - ACCESS AND FUNDAMENTAL PRINCIPLES ARTICLE 1 - Purpose These Terms define the rights and obligations applicable to users, participants, talents, organizers, creators and other persons using CultSports Global.
They govern, among other things, activities, competitions, rankings, voting, events, live services, Channels, content, audiovisual rights, payments, automated services, moderation and community interactions.
ARTICLE 2 - Services CultSports Global may provide Activities, Sports, Culture, Challenges, Competitions, Rankings, Talent, Vote, Events, Live, Channels, Media and News, Marketplace, Community, Intelligence/AI, and any other service subsequently integrated into the ecosystem.
CultSports Global may develop, modify, combine, suspend or discontinue features in accordance with these Terms and applicable law.
ARTICLE 3 - Accounts Information supplied during registration must be accurate and kept reasonably up to date. Each user is responsible for safeguarding account credentials and for activity occurring through the account, subject to applicable law.
CultSports Global may carry out reasonable verification of identity, age, eligibility, authority to represent an organization, payment information, or other matters necessary for the relevant service.
ARTICLE 4 - Minors Participation by minors is subject to applicable law and, where required, the consent or authorization of a parent or legal guardian.
CultSports Global may impose additional safeguards concerning communications, competitions, payments, prizes, live broadcasts, publication, image rights and commercial exploitation involving minors.
TITLE II - ETHICAL PRINCIPLES AND PROHIBITED ACTIVITIES ARTICLE 5 - Human Dignity and Human Rights
Every activity proposed, organized, recorded or broadcast through CultSports Global must respect human dignity and fundamental human rights recognized by applicable law.
Activities or content involving or promoting unlawful exploitation, unlawful violence, degrading treatment, unlawful discrimination, trafficking, forced exploitation or comparable abuse are prohibited. No competition may require, as a condition of participation, conduct that unlawfully violates the dignity or fundamental rights of a participant.
ARTICLE 6 - Animal Protection and Welfare Every activity involving animals must comply with applicable animal-protection and animal-welfare laws and must be conducted in a manner consistent with humane treatment.
Competitions or activities involving cruelty, abuse, unlawful mistreatment or unlawful exploitation of animals are prohibited. CultSports Global may refuse, interrupt, restrict or remove an activity that it reasonably believes violates these principles or applicable law.
ARTICLE 7 - Pornography, Sexual Nudity and Prohibited Competitions CultSports Global is not a pornographic platform. Pornographic content is prohibited.
No competition, activity, challenge or condition of participation may have as its purpose the production of pornographic content. No competition or activity may require participants to expose their genitals or engage in sexual acts, regardless of whether the organizer labels the activity as pornographic.
Strictly necessary exceptions may apply to legitimate informational, educational, health-related or public-interest material, subject to applicable law and CultSports Global's moderation rules.
ARTICLE 8 - Safety of Activities Users must not organize challenges or competitions that unreasonably endanger participants or the public.
A third-party organizer remains responsible for permits, safety measures, equipment, supervision and other obligations applicable to the physical event it organizes.
TITLE III - ACTIVITIES, COMPETITIONS AND RANKINGS ARTICLE 9 - Activities An activity may be sporting, cultural, artistic or belong to another category expressly permitted by CultSports Global. An activity may be governed by specific rules in addition to these Terms.
ARTICLE 10 - CultSports Global as Platform or Organizer The presence of an activity on CultSports Global does not necessarily mean that CultSports Global is its organizer. Depending on the circumstances, CultSports Global may act as a technology platform, broadcaster, producer, co-producer, partner or organizer.
The applicable role shall be determined by the information and contracts relating to the relevant event. Where an event is organized by a third party, that organizer remains responsible for the physical organization and legal obligations assigned to it by applicable law.
ARTICLE 11 - Competition-Specific Rules Each competition may establish specific rules governing categories, eligibility, age, schedule, territory, evaluations, points, voting, judges, artificial intelligence, elimination, prizes, rankings and dispute procedures.
Competition-specific rules supplement these Terms and may govern the competition on matters specifically addressed by those rules, subject to mandatory law and any controlling specific contract.
ARTICLE 12 - Rankings Rankings may take into account objective performance data, human evaluations, votes and automated analysis in accordance with the applicable rules.
Where a methodology materially determines a result, the relevant criteria or weighting shall be disclosed to participants to the extent required by the competition rules and applicable law.
ARTICLE 13 - Competition Integrity Fraud, falsification of performances, result manipulation, bots, fake accounts, artificial voting, collusion, falsification of identity or age, and other material manipulation are prohibited.
CultSports Global may invalidate results, remove votes, disqualify a participant, restrict benefits, or suspend an account, subject to applicable law and any required review procedure.
ARTICLE 14 - Challenges to Results and Decisions CultSports Global may establish a procedure for challenging a ranking, disqualification or competition decision. Deadlines, evidence requirements and review procedures may be specified in the applicable competition rules.
Internal decisions are final within the Platform's process unless a further review is provided, without limiting rights that cannot lawfully be waived.
TITLE IV - CONTENT, RECORDINGS AND ARCHIVES ARTICLE 15 - Recording Principle Public activities, competitions, live events, programs and other audiovisual content carried out or distributed through CultSports Global may be recorded.
Relevant participants are informed of this possibility through these Terms and, where required by law, through additional notice or consent mechanisms. Private communications are not automatically treated as public content and remain subject to applicable privacy and data-protection rules.
ARTICLE 16 - ACTIVITIES-to-CHANNELS Audiovisual Bridge Any eligible public activity carried out within CultSports Activities may be selected for exploitation through CultSports Channels, subject to the necessary rights.
CultSports Global may broadcast, rebroadcast, retransmit, record, edit, technically adapt, translate, dub, subtitle, excerpt, create audiovisual summaries from, incorporate into programs, create highlights from, and archive such content.
Where content is covered by the license granted under these Terms, CultSports Global is not required to obtain a new authorization from the participant for each individual broadcast or rebroadcast, subject to applicable law and third-party rights. Participation in an activity does not guarantee selection for a CultSports Channel.
ARTICLE 17 - License Granted to CultSports Global To the extent the user owns or controls the necessary rights, the user grants CultSports Global a worldwide license to exploit eligible public content supplied or created through the relevant services.
Depending on the service used, this license includes the rights necessary for reproduction, display, performance, broadcast, retransmission, rebroadcast, technical adaptation, editing, translation, dubbing, subtitling, promotion and archiving.
For audiovisual content recorded within CultSports Global activities, the license operates in accordance with these Terms and any applicable specific agreement. Where exploitation of an archive generates revenue during the first two (2) years following its recording, revenue allocation is governed by Article 18A, the CultSports Global Commercial Policy, and any applicable specific contracts.
The two-year revenue-sharing period does not, by itself, mean that CultSports Global's lawful archival or exploitation rights automatically expire at the end of that period. The duration and scope of such rights remain governed by these Terms, applicable law and specific agreements.
ARTICLE 18 - Ownership of Archives and Separation of Rights Recordings, masters, edits, audiovisual programs, graphics, packaging and productions created by CultSports Global may constitute proprietary assets of CultSports Global to the extent recognized by law.
However, storing a recording in the CultSports Global archive does not automatically transfer to CultSports Global pre-existing rights owned by a user, artist, federation, league, composer, producer, director or other rights holder. Such rights remain governed by these Terms, granted licenses and specific agreements.
ARTICLE 18A - Revenue from Archive Exploitation During the First Two Years When audiovisual archives arising from an activity, competition, event, show, performance or other eligible CultSports Global content generate revenue during the first two (2) years following their recording, the relevant revenue may be shared between CultSports Global and the persons or entities entitled to participate economically in the activity.
Depending on the nature of the activity and the rights actually held, eligible beneficiaries may include participants, artists, creators, organizers, promoters, producers, directors, rights holders and other persons or entities contractually entitled to a share of revenue.
The identity of beneficiaries, each beneficiary's share, the calculation base, commissions, deductions, costs, taxes, payment thresholds, payment schedules and other financial terms shall be determined by: (1) the CultSports Global Commercial Policy applicable to the relevant activity or exploitation; (2) the specific rules of the activity, where applicable; and (3) any specific contracts signed with artists, organizers, promoters, producers, directors or other relevant rights holders.
Where a specific contract establishes a particular revenue allocation, that contract prevails for its subject matter over the Platform's general commercial rules, subject to mandatory law.
Mere appearance in an archive does not automatically create a right to revenue participation. The existence and scope of such a right depend on the person's legal and contractual status, the rights held, the applicable rules, the CultSports Global Commercial Policy and any specific agreement.
Archive exploitation may include broadcast, rebroadcast, retransmission, replay, excerpts, highlights, compilations, programming on CultSports Channels and any other use authorized by these Terms and applicable agreements.
ARTICLE 19 - Image, Voice, Name and Performance A participant's image, voice, public name and performance may appear in authorized CultSports Global productions in accordance with these Terms, applicable specific agreements and the law.
Additional safeguards apply to minors and to any situation in which separate consent is legally required.
ARTICLE 20 - Spectators and Public Audiences
The organizer of a physical event must provide notices and obtain permissions concerning audience capture where required by applicable law, with particular care for minors and protected settings.
TITLE V - INTELLECTUAL PROPERTY ARTICLE 21 - Third-Party Rights A user must possess the rights and permissions necessary for content supplied or distributed through CultSports Global. This obligation includes music, images, video, performances, artistic works, trademarks, commentary, broadcast feeds and other protected material.
ARTICLE 22 - Music and Incorporated Works A user's rights in the user's own performance do not necessarily include rights in music, recordings, compositions, choreography or other works incorporated into that performance. The user or organizer must secure the necessary authorizations.
ARTICLE 23 - Notice, Review and Removal CultSports Global may maintain procedures allowing rights holders to report allegedly infringing or unauthorized content.
CultSports Global may remove, disable, restrict or geographically block content during or after review of a claim, and may restore content where appropriate under applicable law and Platform procedures.
ARTICLE 24 - CultSports Global Intellectual Property CultSports Global's trademarks, logos, software, interfaces, designs, databases and proprietary content are protected by applicable intellectual-property laws. Use of the Platform does not transfer ownership of those assets to a user.
TITLE VI - CHANNELS, LIVE SERVICES AND TERRITORIAL RIGHTS ARTICLE 25 - CultSports Channels CultSports Global may operate World Channels, Continental Channels, Regional Channels, Country Channels, City Channels and thematic Channels.
The Platform may activate, deactivate, reorganize or limit Channels according to audience, rights availability, technical conditions, commercial strategy, regulation and other legitimate operational requirements.
ARTICLE 26 - Territorial Exclusivity CultSports Global may sell, license or grant exclusive or non-exclusive broadcast rights for particular territories and may use reasonable geolocation or geoblocking mechanisms to implement those rights.
ARTICLE 27 - VPNs and Territorial Circumvention Users must not intentionally use a VPN, proxy, anonymization service or other mechanism for the purpose of circumventing a territorial restriction applicable to content.
CultSports Global uses reasonable measures to enforce agreed territorial restrictions but does not guarantee that every circumvention technology can be detected or prevented.
Subject to mandatory law, CultSports Global is not responsible for unauthorized circumvention of its territorial protections by a third party acting independently and outside CultSports Global's reasonable control. The Platform may restrict or suspend access when intentional circumvention is detected.
ARTICLE 28 - Translation, Dubbing and Subtitling CultSports Global may provide automated or AI-assisted audio translation, dubbing and subtitling. These services may contain errors or approximations and do not necessarily constitute official or certified translations.
TITLE VII - TECHNICAL INCIDENTS AND LIABILITY ARTICLE 29 - Interruptions, Delays and Cancellations A broadcast may be delayed, degraded, suspended, interrupted or cancelled because of power or Internet outages, network incidents, source-signal failures, cloud or CDN failures, venue problems, equipment failures, weather, natural disasters, cyberattacks, governmental or judicial orders, force majeure or other circumstances outside CultSports Global's reasonable control.
CultSports Global therefore does not guarantee the commencement, uninterrupted continuation or completion of every broadcast.
ARTICLE 30 - Technical Quality Resolution, latency and transmission quality may vary according to network conditions, equipment, location and infrastructure. The Platform may automatically adapt quality and does not guarantee a particular resolution or latency unless expressly stated in a specific commercial commitment.
ARTICLE 31 - Third-Party Providers Some services depend on hosting providers, cloud and CDN providers, telecommunications networks, payment processors, translation providers, app stores and other third-party infrastructure.
CultSports Global does not guarantee uninterrupted operation of systems outside its reasonable control.
ARTICLE 32 - Limitation of Liability To the fullest extent permitted by law, CultSports Global shall not be liable for indirect losses arising solely from events outside its reasonable control.
Nothing in these Terms excludes liability that cannot lawfully be excluded or deprives a consumer of mandatory rights available under applicable law.
TITLE VIII - PAYMENTS, VOTING AND REWARDS ARTICLE 33 - Paid Services Prices and material transaction terms are presented before purchase. Payments may be processed by third-party providers, and taxes, currency-conversion charges or other lawful amounts may apply according to territory and transaction.
ARTICLE 34 - Voting Where a competition uses free or paid votes, the weighting and effect of those votes are determined by the applicable rules. Purchasing a vote never guarantees that a supported participant will win.
Fraudulent or manipulated votes may be cancelled and associated accounts or transactions may be reviewed.
ARTICLE 35 - Prizes and Rewards Delivery of a prize or reward may be subject to verification of identity, eligibility, compliance with competition rules and any legally required documentation.
Recipients remain responsible for their personal tax obligations where applicable.
ARTICLE 36 - Refunds, Credits and Chargebacks Refunds for tickets, live events and other paid services are governed by the applicable refund policy, event terms and mandatory consumer law.
Where appropriate, the applicable terms may provide for a refund, credit, replay, replacement date or other remedy. Fraudulent chargebacks or payment abuse may result in restrictions consistent with applicable law.
TITLE IX - AI, COMMUNITY AND MODERATION ARTICLE 37 - Artificial Intelligence and Automated Systems CultSports Global may use AI or automated systems for recommendations, translation, subtitling, performance analysis, ranking support, fraud detection, moderation and user assistance.
Where required by law or by applicable Platform rules, material automated decisions may be subject to human intervention or review.
ARTICLE 38 - Community Conduct Harassment, threats, unlawful discrimination, impersonation, fraud, manipulation, spam and unlawful activities are prohibited in CultSports Global community spaces.
ARTICLE 39 - Moderation and Enforcement CultSports Global may remove, restrict, demonetize or geographically block content and may warn, suspend or terminate an account for violations of these Terms, applicable rules or law, subject to any legally required notice or review.
TITLE X - INTERNATIONAL COMPLIANCE ARTICLE 40 - Local Laws Users must comply with laws applicable to their activities and territories. Availability of a feature in one country does not guarantee its availability in another.
ARTICLE 41 - Sanctions and International Restrictions CultSports Global may refuse, suspend or restrict a transaction, service or account where reasonably necessary to comply with applicable economic sanctions, embargoes, governmental orders or other legal restrictions.
ARTICLE 42 - Data Protection and Privacy Processing of personal data is governed by the CultSports Global Privacy Policy and applicable data-protection laws. Separate notices or consent mechanisms may apply where legally required.
TITLE XI - FINAL CONTRACTUAL PROVISIONS ARTICLE 43 - Contractual Hierarchy These Terms form the general framework. A specific agreement signed between CultSports Global and a partner, broadcaster, organizer, artist, promoter, producer or rights holder may prevail over these Terms for the specific subject matter it governs.
Competition-specific rules supplement these Terms for the relevant competition. Where several documents apply, specific negotiated provisions prevail over general provisions on the same subject, subject to mandatory law.
ARTICLE 44 - Changes to the Terms CultSports Global may amend these Terms to reflect legal, regulatory, technical, security, functional or commercial developments. Material changes shall be communicated through legally appropriate means.
ARTICLE 45 - Electronic Notices Users agree that contractual and operational notices may be delivered through legally permitted electronic means, including account notices, in-app notifications or email.
ARTICLE 46 - Assignment and Corporate Reorganization Subject to applicable law, CultSports Global's rights and obligations may be transferred in connection with a merger, acquisition, corporate reorganization, financing or transfer of the relevant business.
ARTICLE 47 - Severability If any provision of these Terms is held invalid or unenforceable, the remaining provisions remain effective to the fullest extent permitted by law.
ARTICLE 48 - No Waiver Failure by CultSports Global to enforce a right immediately does not automatically constitute a permanent waiver of that right.
ARTICLE 49 - Languages These Terms may be made available in multiple languages. The legally controlling version shall be designated in the production version according to the operating entity and applicable law, without limiting mandatory consumer language rights.
ARTICLE 50 - Governing Law and Dispute Resolution The governing law, competent forum and any applicable amicable-resolution or arbitration mechanism shall be completed in the production version based on the legal entity operating CultSports Global and its jurisdiction of incorporation.
Nothing in this provision shall deprive consumers of mandatory protections or forums that cannot lawfully be waived in their territory.
FINAL ACCEPTANCE By creating an account, participating in an activity, publishing content or using a service governed by these Terms, the user acknowledges having had access to these Terms and agrees to them in accordance with applicable law.
Where specific authorization is legally required - including for minors, certain image or publicity rights, certain commercial exploitation, or certain processing of personal data - general acceptance of these Terms does not replace any separate consent required by law.
